ARTICLE 1 – PREAMBLE
The site www.shesmou.com (hereinafter ‘the Site’) is published by Maison Shesmou, a company specialising in made-to-measure personalised perfumes, whose head office is located in Vannes, Brittany, France, represented by its founder and director, Mrs Sarah Merciol.
The purpose of these General Terms and Conditions of Use (hereinafter ‘GTU’) is to define the terms and conditions of use of the Site, as well as to define the rights and obligations of the parties in this context.
They can be accessed and printed at any time via a direct link at the bottom of the Site page.
ARTICLE 2 – DEFINITIONS
- Site: refers to the Internet site accessible at the address www.shesmou.com, as well as any sub-sites, mirror sites, portals and URL variations relating thereto.
- User: refers to any person who uses the Site or any of the services offered on the Site.
- Content: refers to all the elements making up the information on the Site, in particular text, images, videos, data, etc.
- Service: refers to all the services offered by Maison Shesmou via the Site, in particular the sale of personalised, made-to-measure perfumes.
ARTICLE 3 – ACCEPTANCE OF THE GTU
Access to the Site is subject to the User’s unreserved acceptance of these GTU.
By using the Site, the User acknowledges that he/she has read these GTU and expressly accepts them.
This acceptance may consist, for example, in the User ticking the box corresponding to the sentence accepting these GTUs, for example with the words ‘I acknowledge that I have read and understood the GTUs and I accept them’.
Ticking this box will be deemed to have the same value as a handwritten signature by the User.
ARTICLE 4 – ACCESS TO THE SITE AND SERVICES
4.1 The Site is accessible free of charge to any User with Internet access. All costs relating to access to the Site, whether hardware, software or Internet access costs, shall be borne exclusively by the User.
4.2 The User is solely responsible for the proper functioning of his/her computer equipment and Internet access.
4.3 La Maison Shesmou reserves the right to refuse access to the Site, unilaterally and without prior notice, to any User who does not comply with these GTU.
4.4 La Maison Shesmou uses all reasonable means at its disposal to ensure quality access to the Site, but is under no obligation to do so.
4.5 Furthermore, La Maison Shesmou cannot be held responsible for any network or server malfunction or any other event beyond its reasonable control, which may prevent or impair access to the Website.
4.6 La Maison Shesmou reserves the right to interrupt, temporarily suspend or modify without notice access to all or part of the Site, in order to carry out maintenance, or for any other reason, without the interruption giving rise to any obligation or compensation.
ARTICLE 5 – CREATION OF A USER ACCOUNT
5.1 Certain Services offered on the Site require the prior creation of a User account. When creating an account, the User undertakes to provide accurate, complete and up-to-date information.
5.2 The User is responsible for maintaining the confidentiality of his/her login and password. Any use of the account with the User ID and password is presumed to have been made by the User.
5.3 The User undertakes to inform Maison Shesmou immediately of any unauthorised use of his/her account or any other breach of security.
ARTICLE 6 – INTELLECTUAL PROPERTY
6.1 All elements of the Site, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents.
6.2 They are the exclusive property of Maison Shesmou. Any User who has a personal website and who wishes to place, for personal use, a simple link on their site referring directly to the home page of the Site, must request authorisation from Maison Shesmou.
6.3 Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the Site, whatever the means or process used, is prohibited, except with the prior written authorisation of Maison Shesmou.
6.4 Any unauthorised use of the Site or of any of the elements it contains will be considered as constituting an infringement and will be prosecuted in accordance with the provisions of articles L.335-2 et seq. of the French Intellectual Property Code.
ARTICLE 7 – PROTECTION OF PERSONAL DATA
7.1 Maison Shesmou respects the privacy of Users and strictly complies with current laws on the protection of privacy and individual liberties.
7.2 The personal data protection policy is available on the ‘Privacy Policy’ page of the Site.
ARTICLE 8 – LIABILITY AND GUARANTEES
8.1 La Maison Shesmou may not be held liable for direct or indirect damage caused to the User’s equipment when accessing the Site, and resulting from the appearance of a bug or incompatibility.
8.2 La Maison Shesmou may not be held liable for any indirect damage (such as loss of business or loss of opportunity) resulting from the use of the Website.
8.3 Interactive areas (comments, opinions) are available to Users. La Maison Shesmou reserves the right to delete, without prior notice, any content posted in these areas that contravenes the legislation applicable in France, in particular the provisions relating to data protection.
8.4 Where applicable, La Maison Shesmou also reserves the right to hold the User civilly and/or criminally liable, particularly in the event of messages of a racist, insulting, defamatory or pornographic nature, regardless of the medium used (text, photographs, etc.).
ARTICLE 9 – HYPERTEXT LINKS
9.1 The Site may contain hypertext links to other Internet sites. La Maison Shesmou cannot be held responsible for the content of these sites or the use that may be made of them by Users.
9.2 Hypertext links to the Site may only be created with the prior written authorisation of Maison Shesmou.
ARTICLE 10 – COOKIES
10.1 The Site uses cookies. These files are stored on the User’s computer to facilitate browsing on the Site and are necessary for its proper operation.
10.2 The User may deactivate cookies by following the instructions provided by his/her Internet browser. However, Maison Shesmou informs the User that certain functionalities of the Site may no longer be accessible.
ARTICLE 11 – APPLICABLE LAW AND JURISDICTION
11.1 These GTU are governed by French law.
11.2 In the event of a dispute, the French courts shall have exclusive jurisdiction.
11.3 If any provision of these GTU is found to be illegal, invalid or for any other reason unenforceable, then that provision shall be deemed severable from these GTU and shall not affect the validity and enforceability of any remaining provisions.
ARTICLE 12 – MODIFICATION OF THE GTU
12.1 La Maison Shesmou reserves the right to modify these GTU at any time.
12.2 The User is invited to consult the GTU regularly in order to take note of any modifications. Continued use of the Site after modification of the GTU implies acceptance of these modifications.
